These Terms and Conditions govern your access to and use of Marny Road's websites and services. By accessing or using our services, you agree to be bound by these terms. Marny Road reserves the right to terminate, suspend, or modify services at any time.

By using our services, you consent to Marny Road's use of THE FLOW — our proprietary AI-enhanced system that combines intelligence, activation, and measurement into a seamless, always-optimizing process. The platform uses an audited database of out-of-home advertising assets with geospatial audience data.

Your data, analysis, and campaign strategies remain private unless explicitly shared. You bear responsibility for third-party integrations and their effects on your data. Marny Road disclaims responsibility for any impacts caused by third-party products or services.

As a user of our services, you agree not to:

• Upload malicious software or code
• Send unsolicited communications (spam)
• Violate intellectual property rights
• Attempt to gain unauthorized access to our systems

You are solely responsible for data backup and protection. Services are restricted to users 18 years of age and older.

You must comply with all applicable U.S. trade laws, export regulations, and OFAC sanctions. You may not operate from embargoed countries or engage with restricted parties. You agree to indemnify Marny Road for any violations of these requirements.

You are responsible for maintaining the security of your account credentials and must report any unauthorized access immediately by contacting us.

Marny Road grants you a limited, non-exclusive, non-transferable license to access and use our software solely for its intended purpose. Reverse engineering, decompiling, or disassembling the software is prohibited except where applicable law (including EU interoperability rights) expressly permits.

Services may be suspended or terminated at any time, with or without cause. Upon termination, your right to access the services ceases immediately, and access to stored information may be lost.

Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Marny Road's total liability is capped at the greater of $20 or three months of fees paid by you for the applicable services. In no event shall Marny Road be liable for any indirect, incidental, special, consequential, or punitive damages.

These terms are governed by the laws of the State of Delaware. All disputes arising from these terms must be litigated exclusively in the courts of Delaware.
